1.Application of the terms of use

FC2, inc ( FC2, FC2 management) and users (users who use FC2 services) are to make an agreement with this contract. Both parties must agree with each term of use.

2.Changing the terms of services

FC2, in its sole discretion, may change the terms of use without prior notice, and encourages you to review the guidelines to ensure you are in compliance every time you use our services.

3.Outline of the services

This service delivers and stores files of text, images and sounds made and uploaded on FC2 web page by users. Since this service belongs to \\\"FC2 ID\\\", the terms of use and operation specification written in FC2 ID has priority. This service consists of a free version and a charged version that requires monthly pay.

4.Member admission and withdrawal

1)Sign-up for free service membership will be completed when a user has agreed to the terms of use and added the service to FC2 ID.

2)Sign-up for charged service membership will be completed when a user has agreed to the terms of use, registered for membership and made the required payment. If a contract for the charged service is canceled, the user will be a free service member.

3)In order to withdraw from this service, please make a cancellation on \\\"FC2 ID\\\" page.

4)Please note that FC2 administration may cancel or freeze a user's account in case the user is judged as inappropriate.

5.Personal information

The personal information of FC2 users will be strictly handled according to FC2 Privacy Policy.

* Responsibilities and bans

7.Bans

Users must not do the following while using FC2 services. If you violate FC2 terms, we will terminate your use of FC2 services without any notice. In case you give any sort of damage to FC2 or any third party, you must compensate for losses.

1) You may not do anything that is against a law or an ordinance.

2) You may not disrupt running of FC2 services and another members' use of FC2 services. Also you may not do or advocate anything that could be troubles to FC2 services and users.

3) You may not defame and smear any particular individual, group, product or other things and damage other peoples' credit, reputation.

4) You may not impersonate any person or entity. Do not falsely state or otherwise misrepresent your affiliation with a person or an entity.

5) You may not disrupt, damage or set a limit on functions of FC2's or another members' computer software/hardware and others, and prompt these actions either.

6) Uploading the following contents, but not limited to, is strictly prohibited.

• Images or sounds which violate any third party's right of ownership, copyright, intellectual property right, trademark right and publicity right.
• Anything that violates other peoples' rights of privacy and publicity rights of portrait.
• Anything that defames other people.
• Anything that goes against general moral or public order and standards of decency.
• Anything that is considered to be a malignant business, excessive advertisement and invitation to a religious organization.
• Anything that contains ethnic, religeous, racial and sexual discrimination.
• Anything that foments crimes such as bodily harm, suicide, use of illegal drugs, stealing and others.
• Anything obscene and violent.
• Child prostitution, pornography without modification and others.

8.Adult contents (There is the age limit.)

1) The contents which require the age limit (adult contents) must be uploaded to the adult category within the FC2 services.

2) The performer, object of shooting, models and any other person who appear in a video must be 18 or over when shot.

3) You may not upload an image or a video in which anyone under 18 performs. You should be able to prove all performers are 18 or over.

4) Users who are 18 or over can watch the adult contents within the FC2 service. Users under 18 are not allowed to watch them.

9.Termination

We will terminate your use of FC2 services and invalidate your account if you infringe our terms or upload above stated contents.

10.Users' responsibilities

Users must be responsible for the following.

1) You must deal with these complaints and claims at your own cost and on your own responsibility; everything you send on or through FC2/use of FC2 services/connection to FC2, violation of the terms, violation of third-partys' rights and others.

2) In case FC2 has to bear costs for complaints and claims arising from your use of FC2, you must be responsible for the costs including attorneys' fees FC2 is charged.

3) If you cause a trouble in the FC2 services, you must resolve it on your own responsibility. In case FC2 or a third-party gets losses, you must be responsible for compensation also.

* Exemption clause and settlement of disputes

11.Exemption from responsibilities

1) Our server does not guarantee to store your data. FC2 has no obligation to store your data and is not responsible for any damages to your data.

2) You must save all the data you made on your own responsibility.

3)When a problem resulting from an uploaded content occurs, the user must take the responsibility.

4) FC2 reserves the right to change, suspend, halt or discontinue services without prior notice. Please note that we are not responsible for troubles caused by changing, suspending, halting or discontinuing services.

5) If you should conflict with another user(s), you must resolve the problem on your own responsibility and again FC2 takes no responsiblities.

6) You must agree that FC2 is not responsible for damages and losses during your use of FC2 site. Please be reminded that we are not responsible for compensation.

7) In case of uncontrollable happening such as, but not limited to, natural disasters, authority's nonfeasance, fires, strikes, floods, epidemics, riots or wars, any person concerned is not responsible for delay and impossibility of performance of contract.

8) This service is provided and managed by FC2 using facilities in the USA. FC2 is not to determine whether the use of FC2 services is appropriate or available in areas or countries other than USA. Therefore a user's access to FC2 is considered to be based on the user's own will. A user must abide by the local laws and be responsible for the use of FC2 services.

12.Settlement of disputes

1) The laws of state of Nevada, USA are applied to the terms of use.

2) All disputes and complaints arising from your use of FC2 services will be resolved by intercession recognized in the state of Nevada.

3) The disputes and complaints that are not resolved by intercession will be taken into court. In this case, a district court in the state of Nevada will have the exclusive jurisdiction for the first trial. Expenses for intercession and litigation as well as attorneys' fees must be paid by the person concerned.

4) Even though the relevant terms are voided and deemed to be impossible to enforce by court, another terms will remain valid and can be applied.
